Terms of Service

1. Definitions
- "Service" — any hosting plan, game server, or related product provided by QuishHost.
- "User" / "you" — any individual or entity with a QuishHost account.
- "Content" — any data, files, or configurations you upload, store, or run on our servers.
- "QuishHost" / "we" / "us", the provider of the Service.
2. Eligibility
You must be at least 18 years old, or the age of legal majority in your country, to enter into these Terms and create an account. If you are under 18, you may only use the Service under the supervision of, and with verifiable consent from, a parent or legal guardian who agrees to be bound by these Terms on your behalf. We reserve the right to request proof of age or consent at any time, and to suspend accounts pending verification.
3. Account
- You are responsible for maintaining the security and confidentiality of your account credentials.
- You must provide accurate and complete information when registering and keep it up to date.
- One account per person. Creating multiple accounts to abuse promotions, evade bans, or circumvent limits is prohibited.
- You must notify us immediately of any unauthorized access to or use of your account.
- You are responsible for all activity that occurs under your account.
4. Acceptable use
You may use our Service only for lawful purposes and in compliance with these Terms. The following are strictly prohibited:
- Hosting, distributing, or executing malware, viruses, or any malicious software.
- Launching DDoS attacks, port scans, brute-force attempts, or any attack or intrusion against third parties.
- Mining cryptocurrency on our infrastructure without prior written permission.
- Hosting, distributing, or linking to illegal content, including pirated software, child sexual abuse material (CSAM), and any content that is unlawful in the jurisdiction where QuishHost operates.
- Impersonating other users, QuishHost staff, or any third party.
- Reselling, sublicensing, or redistributing server resources without explicit written permission from QuishHost.
- Any activity that overloads, degrades, or disrupts shared infrastructure beyond your plan limits or that harms other users.
- Sending unsolicited bulk communications (spam) or violating the rights of third parties.
We reserve the right to investigate suspected violations and to report illegal activity, including CSAM, to the relevant authorities.
5. Supported games and software
QuishHost offers hosting for the specific games and software listed on our website. Running workloads outside the supported list requires prior written approval. We reserve the right to suspend or shut down unsupported, abusive, or violating workloads without notice. Refund eligibility in such cases is governed by our Refund Policy and Section 9.
6. Payment and billing
- Services are billed in advance on a monthly or annual basis.
- Failure to pay will result in service suspension 3 days after the due date and termination 7 days after the due date. Suspended or terminated services may have their data deleted in accordance with Section 9.
- Prices may change with at least 30 days' notice. Existing plans are honored at the current price until their next renewal.
- All prices are stated in EUR or USD and, unless stated otherwise, are exclusive of applicable taxes (including VAT where required). Where we are legally required to charge VAT to consumers, the applicable tax will be shown at checkout.
7. Service availability (SLA)
We aim for 99.5% monthly network uptime. Scheduled maintenance will be announced at least 24 hours in advance where reasonably possible. Uptime calculations exclude scheduled maintenance, force majeure events, outages caused by third-party providers or upstream networks, DDoS attacks, and issues originating from your own configuration or Content. Remedies for failure to meet the SLA, if any, are limited to service credits as described on our website or in your plan.
8. Data and backups
QuishHost may perform periodic backups but does not guarantee their availability, completeness, or integrity. You are solely responsible for maintaining your own independent backups of your Content. To the maximum extent permitted by applicable law, we are not liable for any loss of or damage to your Content. Nothing in this Section limits liability that cannot be excluded by law, including liability for gross negligence or willful misconduct.
9. Suspension and termination
- We may suspend or terminate your account immediately for any violation of these Terms, for non-payment, or where required by law.
- You may cancel your account at any time. Applicable refunds are governed by our Refund Policy.
- Following termination or cancellation, your server data will be retained for up to 7 days and then permanently deleted, unless a longer period is required by law. You are responsible for retrieving your Content before deletion.
10. Limitation of liability
To the maximum extent permitted by applicable law, QuishHost shall not be liable for any indirect, incidental, special, or consequential damages, or for loss of profits, data, or goodwill, arising from or related to your use of the Service. Our total aggregate liability for any claim shall not exceed the total amount you paid to QuishHost in the three (3) months preceding the event giving rise to the claim.
Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for death or personal injury caused by negligence, fraud, or any mandatory rights granted to consumers.
11. Consumer rights
If you are a consumer, you benefit from mandatory protections under the law of your country of residence. Nothing in these Terms affects your statutory rights as a consumer, and where any term conflicts with those rights, your statutory rights prevail. Your right of withdrawal for digital services is described in our Refund Policy.
12. Governing law and jurisdiction
These Terms are governed by the laws of the country in which QuishHost is established, without prejudice to any mandatory consumer-protection laws of your country of residence. Disputes shall be resolved in the courts of that jurisdiction, except where applicable law grants consumers the right to bring proceedings in their own country of residence.
13. Changes to these Terms
We may update these Terms from time to time. We will communicate significant changes via email or in-panel notification at least 14 days before they take effect. Continued use of the Service after the changes take effect constitutes acceptance. If you do not agree to the changes, you may cancel your account before they take effect.
